The Federal Court of Criminal Procedure ordered the proceedings to be discontinued pursuant to § 206a Code of Criminal Procedure, rendering the lower court’s conviction for manslaughter and intentional unlawful possession of a firearm void without requiring formal reversal; consequently, the state shall bear the procedural costs under § 467(1) Code of Criminal Procedure, while the court declined to impose the defendant’s necessary expenses on the state under § 467(3)(2) Sentence 2 Code of Criminal Procedure because the defendant’s appeal lacked prospects of success aside from a minor correction to the finding of guilt. The dispute arose from a revision filed by a defendant convicted by the regional court to ten years and six months imprisonment, which was terminated by the defendant’s death during the appellate proceedings. The decisive legal basis is the application of the procedural impediment of death, which extinguishes the criminal action and triggers standard cost-shifting principles for discontinued proceedings, modified by the assessment that it would be inequitable to charge the state with the defendant’s costs given the likely outcome of the appeal.

1. Das Verfahren wird eingestellt.

Senat, Beschluss vom 30. Juli 2014 – 2 StR 248/14).
