Refusal of non-admission of revision in insurance dispute: lack of need for preliminary EU reference on good faith defense
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiffs' non-admission appeal, thereby upholding the appellate court's decision and leaving the lower judgment in force, with the plaintiffs bearing the costs of the proceedings. The dispute, valued at €63,196.96, concerned a challenge to an insurance policy model and alleged breaches of good faith. The court held that the question of whether the policy model was compliant with the EU Product Liability Directive was not decisive for the outcome and that a preliminary reference to the Court of Justice of the European Union regarding the defense of good faith was not required, citing recent senate precedent.
