Valuation of amount in dispute for non-admission complaint: Net loan amount in linked transactions versus principal excluding ancillary interest
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) ordered that the amount in dispute for the non-admission complaint procedure be set at a maximum of €20,000. This decision arose from a dispute regarding a consumer loan contract where the borrower claimed a negative declaratory judgment to counter the lender's demand for repayment, involving a linked transaction for the purchase of books. The court determined that while a calculation based on the lender’s claimed principal would result in an amount under €20,000 (excluding interest as ancillary claims under § 4 Abs. 1 Halbsatz 2 ZPO), the decisive factor was the borrower’s argument that the loan was part of a linked transaction aimed at the validity of the contract withdrawal. Consequently, the amount in dispute was fixed at the net loan amount of exactly €20,000, referencing prior Senate case law on the valuation of such claims.

Senatsbeschluss vom 17. Mai 2022 - XI ZR 359/21, juris mwN). Dieser beträgt vorliegend genau 20.000 €.
