Engine Manufacturer Liability for Emissions Scandal: Admissibility of Revision Against Rejection of §§ 823, 826 BGB and EG-FGV Claims
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-admission of revision, thereby upholding the lower court's judgment in which the plaintiff prevailed over no claim. The dispute concerned a civil action for damages based on alleged emissions manipulation, where the plaintiff sought compensation against an engine manufacturer rather than the vehicle manufacturer. The court rejected the admission of revision because the plaintiff failed to substantiate that the lower court’s dismissal of the tort claim under § 823(2) BGB in conjunction with the General Food Law Act (EG-FGV) was erroneous, noting that the defendant did not commit a willful violation as a necessary accessory to the vehicle manufacturer's actions. Additionally, the claim under §§ 826, 31 BGB lacked admissible grounds for appeal, and alleged procedural rights violations were deemed unfounded, resulting in the plaintiff bearing the costs of the proceedings.
