Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice dismissed the plaintiff's complaint, upholding the Higher Regional Court of Cologne's refusal to admit an appeal to the supreme court and ordering the plaintiff to bear the costs, with a disputed value of €49,640.02. The dispute concerned a civil insurance or policy model case, where the plaintiff challenged the lower court's procedural decision not to admit revision. The court held that the issue of the policy model's compliance with EU directives was not decisive for the outcome, and that no preliminary reference to the Court of Justice of the European Union was required regarding the defense of good faith and equitable dealing, as established in recent case law. Consequently, the decision found that the case lacked fundamental significance, a need for legal development, or the necessity to secure uniform jurisprudence under § 543 Abs. 2 Satz 1 ZPO.
