Admissibility of non-admission complaint: absence of fundamental significance or need for uniform legal practice in civil revision
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiff's complaint for non-admission of revision, upholding the lower court's decision and ordering the plaintiff to bear the costs of the complaint proceedings; the dispute concerned a civil matter where the plaintiff failed to demonstrate that the case held fundamental significance or required revision to ensure uniform legal practice. The court rejected the alleged violations of procedural fundamental rights and dispensed with a detailed legal justification pursuant to § 544 Abs. 6 ZPO, as such an explanation would not contribute to clarifying the prerequisites for admitting revision, thereby confirming the finality of the appellate court's ruling.
