Inadmissibility of legal complaint against rejection of judicial recusal complaint
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's application for the appointment of a standby attorney and rejected his appeal as inadmissible, leaving the lower court's decision in force. The dispute concerned a civil procedure where the plaintiff sought to challenge a Regional Court order that had dismissed his immediate complaint against a District Court decision denying his motion for recusal of a judge. The court held that the attempted "complaint against non-admission" was mislabeled as a legal complaint (Rechtsbeschwerde), which is not admissible here because neither the statute nor the impugned order permitted such an appeal, rendering the proceeding futile and justifying the refusal of legal aid. The decision was based on § 78b(1) of the Code of Civil Procedure (ZPO) regarding the conditions for appointing a standby attorney (specifically the requirement that litigation not be hopeless) and § 574(1) sentence 1 ZPO, which stipulates that a legal complaint is only permissible if explicitly provided for by law or admitted by the underlying order.
