Proof of commercial intent in foreign trade law violations: Validity of using anticipated economic gains and VAT deductions to establish non-temporary income source
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Criminal Third Senate (BGH 3. Strafsenat) dismissed the defendant's revision as unfounded, upholding the conviction and ordering him to bear the costs of the appeal. The case involved a criminal prosecution for violations of foreign trade law (Außenwirtschaftsrecht), specifically challenging the trial court's determination of the "commercial nature" (Gewerbsmäßigkeit) of the offense under § 18 Abs. 7 Nr. 2 AWG. The appellate court had relied on the defendant's detailed price calculations—including a planned deduction of input VAT on the purchase of goods—to establish that he intended to secure a non-temporary source of income of significant scale through repeated criminal acts. The BGH confirmed that this method of proof was legally sound, ruling that the assessment of commercial intent focuses on the economic situation the perpetrator anticipated from the crimes, regardless of whether the required export permits could actually be obtained or if the statutory prerequisites for the intended VAT deduction were fully met.

Strafbarer Verstoß gegen Außenwirtschaftsrecht: Nachweis der Gewerbsmäßigkeit
[TENOR]
