Insurance policy model and good faith defense: no need for CJEU reference or revision
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-admission of revision, upholding the lower court's judgment and ordering the plaintiff to bear the costs. The dispute concerned an insurance contract, specifically challenging the EU directive-compliance of the policy model and the defense of *Trau und Glauben* (reliance and good faith), with a claimed value in dispute of €201,217. The court held that the question of directive-compliance was not decisive for the outcome and that a preliminary reference to the Court of Justice of the European Union was unnecessary, citing consistent Senate jurisprudence; it also rejected procedural complaints under Article 2(1) and Article 19(4) of the Basic Law, finding that the case lacked fundamental significance, necessity for legal development, or need for uniform jurisprudence under § 543(2) sentence 1 ZPO.
