The German Federal Court of Justice dismissed the plaintiff's application for suspension of proceedings and rejected her complaint against the non-admission of appeal, thereby upholding the Munich Higher Regional Court's earlier decision and leaving the lower court ruling in force. The dispute concerned a civil matter where the plaintiff challenged the appellate court's refusal to allow a revision on the grounds of fundamental legal significance, judicial law development, or the need for uniform jurisprudence. Relying on § 543(2) sentence 1 ZPO, the court determined that the case lacked such significance and that a revision was not required for legal consistency, explicitly noting that it had assessed and negated the success chances of a hypothetical revision in accordance with established procedural standards, while also denying costs and setting the value in dispute at up to €40,000.

Juli 2020 (XI ZR 387/19, juris). Von einer weiteren Begründung wird gemäß § 544 Abs. 6 Satz 2 Halbs. 2 ZPO abgesehen.

Die Klägerin trägt die Kosten des Beschwerdeverfahrens (§ 97 Abs. 1 ZPO).

Der Gegenstandswert des Beschwerdeverfahrens beträgt bis zu 40.000 €.
