Legislator-Zusammenfassung

The Federal Court of Justice dismissed the plaintiff's complaint against the non-admission of revision, thereby upholding the lower court's decision and leaving the defendant's victory intact. The dispute concerned a civil procedure where the plaintiff had filed a validly rejected appeal against a first-instance judgment via a unanimous order under § 522 Abs. 2 ZPO, and subsequently attempted to extend the claim in the second instance; the court held that because the underlying appeal was dismissed by such an order, the subsequent claim expansion in the appellate instance automatically lost its effect and did not need to be considered by the appellate court. The decisive legal basis is § 543 Abs. 2 Satz 1 ZPO for the non-admission of revision, and the procedural doctrine under § 524 Abs. 4 ZPO in conjunction with § 522 Abs. 2 ZPO, which dictates that claim expansions made after a dismissed appeal are rendered void.
