Hearing complaint rejected: adequacy of appellate reasoning on supplemental brief and leave for revision under § 543(2)(1)(2) ZPO.
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's complaint (Anhörungsrüge) against the Fifth Civil Senate's order of May 22, 2023, which refused leave for a revision appeal; consequently, the lower court’s denial of leave stands, and the complaint was rejected at the plaintiff's expense. The dispute concerned a civil procedure in which the plaintiff alleged that the appellate senate failed to consider a supplemental submission filed on February 20, 2023, within the deadline for justifying leave to appeal. The court determined that the complaint was unfounded under § 321a Abs. 4 Satz 3 ZPO because the senate had explicitly acknowledged the supplemental arguments and reaffirmed in its prior decision that the alleged lack of reasoning did not justify a revision appeal under the ground of securing uniform legal application (§ 543 Abs. 2 Satz 1 Nr. 2 ZPO), thereby finding no procedural error warranting relief.

BGH, Beschluss vom 24. Mai 2023 - VII ZR 139/22, juris Rn. 3; Beschluss vom 21. Juni 2023 - VII ZR 158/22, juris Rn. 3 mwN).
