Liability of motor component manufacturer in tort based on alleged participation in vehicle manufacturer's intentional violation of emission regulations
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) dismissed the plaintiff’s appeal, upholding the lower court’s rejection of liability, thereby resulting in a complete victory for the defendant manufacturer. The dispute centered on a tort claim under § 823 Abs. 2 BGB in conjunction with the EU Fuel Emissions Directive, where the plaintiff alleged that a motor component manufacturer was liable for contributing to an intentional legal violation committed by the vehicle manufacturer. The court held that the appeal lacked substantive merit because the plaintiff failed to sufficiently demonstrate the relevance of the claimed legal issues; specifically, the distinction between the defendant as a motor manufacturer and the liable party as a vehicle manufacturer was not adequately addressed in the appeal, rendering the grounds for admission inadmissible. Consequently, the plaintiff bears the costs of the proceedings, and the lower court’s decision denying the claim remains in force.
