Qualifying as Use of a Forbidden Tool in Vehicle Theft: Signal Amplification of Keyless-Go System
Legislator-Zusammenfassung
KI-generiert**Outcome:** The Federal Court of Justice (BGH) dismissed the defendant's revision as unfounded, upholding the Landau Regional Court's conviction and ordering the defendant to bear the costs of the appeal. **Dispute and Facts:** The case involved the appeal against a conviction for particularly serious vehicle theft, specifically challenging whether the use of signal amplifiers to extend the range of a "Keyless-Go" system constituted a legal form of theft. The defendant used these amplifiers to wirelessly trigger the vehicle's locking mechanism to open the car and start the engine without a physical key. **Legal Basis:** The court held that the action met the requirements for theft under § 243 Abs. 1 Satz 2 Nr. 1 StGB, which punishes execution of the crime with a tool not intended for proper opening. The court reasoned that the amplifiers functioned analogously to a key by improperly moving the locking mechanism, thereby effecting an unlawful entry into an enclosed space.

Besonders schwerer Fahrzeugdiebstahl: Verlängerung des Funksignals eines Keyless-Go-Systems
[TENOR]
BGH, Beschluss vom 17. Oktober 2017 – 3 StR 349/17).
