The Federal Court of Justice (BGH) partially granted the defendant’s revision, ordering the court to refrain from the confiscation of the seized iPad while dismissing the remainder of the appeal and upholding the lower court’s order for involuntary placement in a psychiatric hospital; the defendant was assessed with the costs of the appellate proceedings. The dispute centered on the legality of the confiscation of an iPad used as an instrument of crime in the original judgment, which had been entered without any reasoning regarding the discretionary nature of the order. Applying Section 421(1) No. 2 of the Code of Criminal Procedure (StPO), the court held that the complete absence of reasoning in the first-instance judgment on the discretionary exercise required for confiscation created a reasonable concern that the lower court treated the measure as mandatory, thus warranting the refusal of confiscation for procedural economic reasons, despite the overall minor success of the revision.

Absehen von der Einziehung durch das Revisionsgericht: Verfahrensökonomische Gründe

[TENOR]
