Admissibility of revision in insurance law: irrelevance of directive conformity and EU preliminary reference on trust and reliance
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff’s complaint against the non-admission of revision, leaving the appellate court’s decision in force and ordering the plaintiff to bear the costs of the proceedings. The dispute concerned a civil insurance matter where the plaintiff challenged the refusal to admit a revision appeal, raising arguments regarding the directive conformity of the insurance policy model and the "Trau und Glauben" (trust and reliance) principle. The court held that the question of directive conformity was not decisive for the outcome in this specific case, and it was not necessary to refer the "Trau und Glauben" issue to the Court of Justice of the European Union, citing recent Senate jurisprudence. Consequently, the court concluded that the case lacked fundamental significance, did not require further development of the law, and did not need to ensure uniform legal application under § 543 Abs. 2 Satz 1 ZPO.
