Non-admission complaint rejected due to lack of fundamental significance and denied revision prospects
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the plaintiff's application for a stay of proceedings and rejected his non-admission complaint, resulting in the plaintiff's defeat and the lower court's decision remaining in force. The dispute involved a civil matter where the plaintiff challenged the 19th Civil Senate of the Munich Higher Regional Court's refusal to allow an appeal to the BGH, arguing that the case involved a question of fundamental legal significance. The BGH held that no fundamental significance existed and that the development of law or uniform jurisprudence did not require a revision, explicitly noting that the chances of a successful appeal were denied pursuant to constitutional case law. The decision was grounded in §§ 543(2) sentence 1 and 544(6) sentence 2 of the Code of Civil Procedure (ZPO), with the court referencing recent BGH rulings from May, June, and July 2020 instead of providing a full written rationale.
