The Federal Court of Justice (11th Civil Division) dismissed the plaintiff's application to stay the proceedings and rejected his complaint for non-admission against the Munich Higher Regional Court's decision, thereby upholding the lower court's ruling. The dispute concerned a civil matter where the plaintiff challenged the appellate court's refusal to admit the case to the federal level. The Court determined that the legal question lacked fundamental significance and that the development of law or uniformity of legal application did not require a decision by the revision court, noting that it had assessed and negated the prospects of success for a potential revision. Relying on established case law, the Court declined to provide a separate detailed rationale, citing previous rulings from 2020 on identical issues, and ordered the plaintiff to bear the costs of the complaint proceedings.

Juli 2020 (XI ZR 387/19, juris). Von einer weiteren Begründung wird gemäß § 544 Abs. 6 Satz 2 Halbs. 2 ZPO abgesehen.

Der Kläger trägt die Kosten des Beschwerdeverfahrens (§ 97 Abs. 1 ZPO).

Der Gegenstandswert des Beschwerdeverfahrens beträgt bis zu 35.000 €.
