Legislator-Zusammenfassung

KI-generiert

The German Federal Court of Justice (BGH) 2nd Criminal Senate rejected the defendant's appeal with modifications, upholding the lower court's conviction while ordering the confiscation of the value of criminal proceeds totaling 591,490.90 Euro, of which 12,316.50 Euro is declared a joint and several liability. The dispute concerned the sufficiency of the trial court's reasoning regarding the exclusion of confiscation where an accomplice's spouse may have qualified as a good-faith third-party beneficiary under § 73e Abs. 2 StGB. Although the appellate court found the trial judgment's reasoning on this specific statutory exclusion insufficient, it bypassed remand by affirming the confiscation order and adding a joint and several liability clause to ensure the defendant bears the financial burden, thereby upholding the General Public Prosecutor's request to close the legal gap without allowing the defendant to benefit from the procedural deficiency.
