The Federal Court of Justice (BGH) dismissed the plaintiff's objection to the senior judge's decision and denied his application for the appointment of a *Notanwalt* (emergency counsel), thereby upholding the court's procedural rulings and leaving the final judgment intact. The dispute arose in a civil proceeding before the BGH 5th Civil Senate, where the plaintiff attempted to challenge the final judgment by filing a *Gegenvorstellung* (objection) against a prior interim order and a petition for legal aid to file a complaint against violation of the right to be heard (*Anhörungsrüge*), arguing that the court failed to adequately address his arguments. The court held that the *Gegenvorstellung* was inadmissible because the proceedings had been conclusively terminated by the final judgment, and the application for appointed counsel was rejected under § 78b Abs. 1 ZPO as the intended *Anhörungsrüge* was hopeless; the court reasoned that the plaintiff had merely repeated arguments previously considered by the Senate in an earlier order, and the court is not required to address every submission explicitly in the reasoning of a final, non-appealable decision, noting that the lack of a favorable outcome does not constitute a violation of the right to be heard.

Beiordnung eines Notanwalts: Aussichtslosigkeit der beabsichtigten Anhörungsrüge

[TENOR]

1. Die Gegenvorstellung des Klägers vom 24. Juli 2020 gegen den Beschluss des Senats vom 8. Juli 2020 wird als unzulässig verworfen.
