Tort claim against engine manufacturer under Emissions Goods Act and § 823 Abs. 2 BGB
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's complaint against the non-admission of appeal, leaving the lower court's judgment in force; the plaintiff, a vehicle owner, failed to establish a tort claim under § 823 Abs. 2 BGB in conjunction with the Emissions Goods Act against the defendant, an engine manufacturer. The court determined that the complaint did not adequately demonstrate the decision-relevance of the alleged legal errors because the defendant was not the vehicle manufacturer, and the plaintiff failed to sufficiently substantiate a claim that the vehicle manufacturer’s intentional violation of law constituted a participation offense in which the engine manufacturer could be implicated. Consequently, the court found no basic legal significance or need for further development of law to justify a revision, placing the costs of the appellate proceedings on the plaintiff.
