Admissibility of revision and prospects of success under §§ 543, 552a ZPO
Legislator-Zusammenfassung
KI-generiertThe BGH 11th Civil Senate dismissed the plaintiff's motion to stay proceedings and rejected the plaintiff's revision by unanimous decision, ordering the plaintiff to bear the costs, thereby upholding the appellate judgment of the OLG Cologne. The case involved a civil dispute where the plaintiff challenged the second-instance ruling via revision, but the court determined that the legal issue held no general significance, did not require the development of law or uniform jurisprudence, and the appeal lacked prospects of success. The decision was grounded in § 543 Abs. 2 Satz 1 ZPO (dismissal for lack of relevance or prospects) and § 552a ZPO, with the substantive reasoning relying on the President's letter and a related Senate decision, while the dispute value for the revision proceedings was set at up to €25,000.
