Harmless error of statutory minimum sentencing threshold in robbery conviction
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice, 3rd Criminal Senate, dismissed the defendant's appeal against the Landgericht Kleve's conviction for robbery with aggravated circumstances, leaving the original sentence of two years and three months in force and ordering the appellant to bear the costs of the legal remedy. The dispute centered on a claim of error in the sentencing framework for the specific count of robbery, where the lower court had incorrectly applied a six-month minimum statutory minimum instead of the correct three-month threshold under §§ 255, 249 Abs. 2, § 23 Abs. 2, and § 49 Abs. 1 StGB. The supreme court upheld the conviction under § 349 Abs. 2 StPO, ruling that the legal error was harmless because the final individual sentence clearly did not rest on the lower limit of the sentencing range, making it unlikely that the court would have imposed a lesser penalty had the correct statutory minimum been applied.
