Legislator-Zusammenfassung

The Federal Court of Justice (BGH) amended the court fee determination, setting the dispute value for the non-admission complaint at €111,090.21, thereby implicitly upholding the plaintiff’s objection that the initial valuation erroneously double-counted specific damages. The dispute concerned the calculation of the statutory dispute value in a civil procedure, where the lower court had incorrectly included claimed lost investment interest of €41,435.53 as a distinct component increasing the total value. Applying Section 4(1), second sentence, of the Code of Civil Procedure (ZPO) in conjunction with Sections 3, 5, and 47 of the Courts and Legal Services Act (GKG), the court ruled that lost profit claimed as a fixed percentage of a specific sum constitutes a subordinate claim (Nebenforderung) to the main claim and does not increase the dispute value beyond the principal amount.

Streitwerterhöhung bei Geltendmachung einer Nebenforderung

[TENOR]
