The German Federal Court of Justice dismissed the complainant's appeal as inadmissible, thereby upholding the order of the Frankfurt Superior Court of Justice and assigning the costs of the unsuccessful appeal to the complainant. The dispute concerned a decision issued by the Superior Court following an agreed termination declaration in notarial administrative proceedings, where the complainant challenged the court's cost allocation. The court held that the appeal was inadmissible because, under the interplay of the Court Officers Act (§ 67 BDG), the Federal Notaries Act (§ 105 BNotO), and the Administrative Courts Act (§§ 92, 96, 146, 158 VwGO), decisions resulting from agreed terminations and their associated cost determinations are legally unappealable.
