Participation in EU Gasoline Vehicle Regulation violations by engine manufacturers under German tort law
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-admission of the appeal, thereby upholding the appellate court's judgment that denied liability and leaving the lower court's decision final. The dispute concerned a tort claim under German law alleging that an engine manufacturer had participated in a vehicle manufacturer's intentional violation of the EU Gasoline Vehicles Directive (EG-FGV) through a software defect. The BGH held that the plaintiff failed to demonstrate the relevance of the alleged grounds for appeal, specifically noting that the defendant was merely an engine manufacturer rather than a vehicle manufacturer, and thus did not sufficiently plead a tortious act by the vehicle manufacturer with which the defendant could have co-participated; additionally, alleged violations of procedural fundamental rights were examined but deemed unfounded. Consequently, the plaintiff is ordered to bear the costs of the complaint proceedings, and the BGH declined to provide further reasoning as it would not contribute to clarifying the requirements for admitting an appeal under § 543 Abs. 2 ZPO.
