Admissibility of appeal for non-admission of revision: lack of fundamental legal significance and denied reformatory review
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiff’s application to stay proceedings and rejected the plaintiff’s appeal against the admission of the ordinary appeal, leaving the lower court’s decision in force. The dispute concerned a civil matter where the plaintiff argued that the case possessed fundamental legal significance and required the revision court to develop the law or ensure uniform jurisprudence. The BGH determined that the legal issue did not meet the threshold for such significance, found that an ordinary appeal would not have been successful, and relied on its prior decisions to justify denying a separate detailed reasoning under § 544(6)(2) No. 2 of the Code of Civil Procedure (ZPO). Consequently, the plaintiff was ordered to bear the costs of the appellate proceedings.
