Allocation of necessary legal expenses following dismissal of proceedings due to death of accused
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice ordered the dismissal of the criminal proceedings and ruled that the State Treasury bears the procedural costs, explicitly refusing to charge the defendant’s necessary expenses to the State Treasury. The dispute arose after a regional court sentenced the defendant to 14 years and 6 months for murder committed in conjunction with robbery resulting in death; the defendant filed a revision which became moot upon his death during the appellate process. Relying on § 206a StPO, the court established that the death of the accused constitutes a procedural impediment rendering the underlying judgment ineffective without formal reversal. Under §§ 467 Abs. 1 and 3 Satz 2 Nr. 2 StPO, the court applied the doctrine that it is inequitable to impose the defendant's necessary expenses on the State Treasury because the defendant was not finally acquitted on the merits, but rather escaped conviction solely due to the supervening procedural barrier, and the revision had no prospect of success.

Senat, Beschluss vom 30. Juli 2014 - 2 StR 248/14).
