The Federal Court of Justice (4th Criminal Senate) dismissed the defendant's appeal as unfounded, upholding the judgment of the Landgericht Bochum dated April 30, 2018, and ordered the defendant to bear the costs of the appeal and the necessary expenses of the auxiliary plaintiff incurred in the appellate proceedings. The dispute centered on the defendant's contention that the lower court violated § 261 StPO by incorrectly evaluating a video recording of the high-dynamic incident viewed in open court, specifically through the submission of still images which the appellate court deemed insufficient to constitute the evidentiary material in question. The court held that the appeal was inadmissible because the assessment of the significance of video recordings or their still frames requires a holistic evaluation that is exclusively within the purview of the trial judge and is not reviewable by the appellate court without a reconstruction of the evidentiary proceedings, citing § 349 Abs. 2 StPO and the doctrine that such factual determinations are shielded from revision if the original recording or proper evidentiary basis was not adequately presented.

April 2003 - 1 StR 64/03, BGHSt 48, 268, 273; vom 19. Dezember 1995 - 4 StR 170/95, BGHSt 41, 376, 380; MüKo-StPO/Miebach, § 261 Rn. 418; Meyer-Goßner/Schmitt, StPO, 62. Aufl., § 261 Rn. 38b).
