Tort liability of engine manufacturer under § 823(2) BGB for participating in vehicle emission fraud
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's non-acceptance complaint, upholding the Munich Regional Court of Appeal's decision to deny the claim. The dispute concerned a tort action under § 823(2) BGB in conjunction with the EU Emissions Trading Regulation, where the plaintiff attempted to hold the defendant, an engine manufacturer, liable for alleged emissions fraud. The court ruled that the plaintiff failed to demonstrate the admissibility of the appeal because it did not sufficiently substantiate a finding that the engine manufacturer participated in an intentional statutory violation by the vehicle manufacturer, which is a prerequisite for liability in this context. Consequently, the lower court's judgment stands, and the plaintiff is ordered to bear the costs of the proceedings.
