Start of limitation period for embezzlement of wages: due date versus extinguishment of contribution liability
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) Second Criminal Senate agreed with the First Criminal Senate's legal view, explicitly overruling its own prior jurisprudence to resolve a conflict regarding the statute of limitations. In a case concerning the embezzlement of labor remuneration (§ 266a StGB), the court addressed the dispute over when the five-year prosecution limitation period under § 78 Abs. 3 Nr. 4 StGB begins to run for such omission offenses. The court rejected the previous doctrine that the limitation period starts only when the contribution obligation extinguishes after thirty years under § 25 Abs. 1 Satz 2 SGB IV, deeming the resulting total limitation period unreasonably long. Instead, the court held that the start of the limitation period must be linked to the due date of the payment obligation as defined in § 23 SGB IV, characterizing these offenses as "due-date offenses" (Fälligkeitsdelikte) and considering that the limitation period generally begins with the completion of the offense or the occurrence of the result under § 78a StGB.

Vorenthalten und Veruntreuen von Arbeitsentgelt: Fristbeginn der Strafverfolgungsverjährung
[TENOR]
Der Senat stimmt der Rechtsansicht des anfragenden 1. Strafsenats zu. Er gibt entgegenstehende eigene Rechtsprechung auf.
[GRUENDE]
StGB, 2016, S. 545 ff.; Bachmann, JR 2020, 370 ff.; LK/Greger/Weingarten, StGB, 13. Aufl., § 78a Rn. 2).
