Tenancy termination: Calculating the in dispute value for non-admission complaint thresholds under §§ 8, 9 ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Civil Procedure (8th Civil Senate) rejected the defendant's application for legal aid to file a non-admission complaint, thereby leaving the Hamburg District Court's eviction judgment in force. The dispute concerned the termination of an indefinite residential tenancy agreement, where the tenant sought to challenge the appellate decision on procedural grounds. The court held that the complaint was inadmissible because the matter's value did not meet the statutory threshold of €20,000 required under the Court Organization Act for such appeals; based on the doctrine that the amount in dispute is three-and-a-half times the annual net rent for indefinite leases, the calculated value of approximately €17,166 was insufficient to satisfy the jurisdictional requirement.

Zulässigkeit der Nichtzulassungsbeschwerde: Beschwerdewert bei einem Räumungsrechtsstreit
[TENOR]
