Inadmissibility of legal complaint against local court decision due to missing statutory basis and lack of BGH-counsel representation
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the appellants' challenge as inadmissible and ordered them to bear the costs, leaving the lower court's decision in force. The appellants had attempted to appeal a decision issued by a local court (Amtsgericht) using a document ambiguously labeled as a "complaint" or "revision," which the BGH reclassified as an attempted legal complaint (Rechtsbeschwerde). The court found the remedy inadmissible on two grounds: first, the statutory prerequisites for allowing a legal complaint against a decision of a local court were not met, as the originating court lacked the specific jurisdiction to open that appeal path; and second, the appeal failed the mandatory procedural requirement that such appeals must be filed by an attorney admitted to the Federal Court of Justice.
