Consumer loan: Validity of withdrawal information where general terms displace statutory deadline calculation rule
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice rejected the borrowers' non-admission complaint, thereby upholding the appellate decision and allowing them to bear the costs of the proceedings. The dispute concerned the validity of a consumer loan agreement, specifically whether the borrower's right of withdrawal was invalidated by the lender's general terms and conditions attempting to opt out of the statutory interpretation rules for calculating the withdrawal deadline. The Court held that the clause excluding the application of § 193 BGB did not render the withdrawal information improper, as the specific contractual stipulation regarding deadline calculation did not infringe upon the necessary transparency requirements of the consumer credit disclosure, and the matter lacked fundamental legal significance or need for uniform case law development.
