The Federal Court of Justice (BGH) dismissed the defendant's complaint against the non-admission of revision, thereby upholding the judgment of the Higher Regional Court of Cologne and leaving that decision final; the defendant, who sought to overturn the lower court's ruling, prevailed in no aspect, while the plaintiff's original claim and the defendant's counterclaim for declaratory relief regarding a damages claim under an insurance contract remain in force. The dispute involved an insurance law case where the defendant challenged the denial of access to the Supreme Court, arguing violations of equal treatment and the right to a hearing under the German Basic Law. The court rejected the complaint, finding that the matter lacked fundamental legal significance, the need for legal development, or the necessity of ensuring uniform jurisprudence under § 543 Abs. 2 Satz 1 ZPO, and deemed the constitutional complaints under Art. 3 Abs. 1 and 103 Abs. 1 GG unfounded; consequently, the defendant bears the costs of the complaint proceedings, with a statutory amount in dispute set at up to €260,000.
