Rechtsbeschwerde inadmissible for lack of mandatory legal representation and misinterpretation of service requirements for signed court decisions
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the defendant's legal complaint (Rechtsbeschwerde) as inadmissible, ordering the complaint to be rejected at the complainant's costs, thereby upholding the lower court's decision. The dispute arose from the defendant's attempt to personally file an appeal against a Landgericht decision without the mandatory representation by a lawyer admitted to the BGH, coupled with a challenge to the lack of judges' and clerk's signatures on the served document. The court ruled that the absence of counsel's signature rendered the complaint inadmissible under § 78 Abs. 1 Satz 3 ZPO, and dismissed the signature objection by clarifying that parties are entitled only to a certified copy or, upon request, an execution copy, while the original signed decision remains with the court pursuant to §§ 317, 329 ZPO. The case value was set at €10,200.

Juni 2020 - VIII ZB 28/20, juris Rn. 3; vom 8. November 2022 - VIII ZB 61/22, juris Rn. 4).
Der Gegenstandswert des Rechtsbeschwerdeverfahrens wird auf 10.200 € festgesetzt.
