Sufficiency of appellate review basis regarding the mandatory recitation of a defendant's statement in criminal judgments
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) second Criminal Senate dismissed the defendant's revision as unfounded, upholding the criminal conviction handed down by the regional court of Erfurt, with the defendant bearing the costs of the appellate proceedings. The dispute centered on a procedural defect regarding the sufficiency of the trial court's reasoning, specifically whether the failure to explicitly record and evaluate the defendant's oral statement in the judgment violated mandatory sentencing and reasoning standards. The Court held that while Section 267 of the Code of Criminal Procedure does not strictly mandate a textual reproduction and evaluation of the defendant's statement in the judgment, such a recitation is generally required to allow the appellate court to verify the factual basis of the conviction and the correct application of substantive law. However, the omission was deemed harmless in this instance because the overall context of the judgment clearly established that the defendant remained silent on both personal and factual matters during the main hearing.

Notwendige Wiedergabe der Einlassung des Angeklagten im Urteil
[TENOR]
