Consent to media statements inferred from absence of confidentiality agreement in right-to-be-heard complaint
Legislator-Zusammenfassung
KI-generiertThe defendant's motion to be heard (Anhörungsrüge) against a prior Senate decision was rejected, and the plaintiff prevailed. The dispute concerned an appeal for non-admission in a civil case, specifically challenging the appellate court's failure to hear a witness regarding whether the plaintiff's family had consented to a clergy member's public statements. The Federal Court of Justice held that the right to be heard under Article 103(1) of the German Basic Law was not violated because the defendant failed to identify specific arguments made in the lower instances supporting a finding of consent; the mere absence of a confidentiality agreement did not imply consent, and since the appellate court had already assumed the defendant's version regarding the lack of confidentiality, it was legally correct not to summon the witness.
