Inadmissibility of non-admission complaint against refusal of remaining debt discharge due to lack of express statutory or judicial leave
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the debtor's application for legal aid, thereby denying the filing of a non-admission complaint against the Landgericht Hannover's order denying remaining debt discharge. The dispute centered on whether a higher court review could be sought against the lower court's refusal to grant discharge in insolvency proceedings. The court held that the intended legal pursuit lacked a sufficient prospect of success because, under § 4 InsO in conjunction with § 574(1) Sentence 1 ZPO, an appeal (Beschwerde) against a decision is only permissible if explicitly provided by law or admitted by the lower court, neither of which occurred in this case. Furthermore, the non-admission of an appeal is not subject to challenge, distinguishing it from revisions, and an extraordinary complaint is neither available nor constitutionally required.

Rechtsmittel gegen eine Versagung der Restschuldbefreiung
[TENOR]
BGH, Beschluss vom 7. März 2002 - IX ZB 11/02, BGHZ 150, 133, 135 ff) und verfassungsrechtlich auch nicht geboten (BVerfGE 107, 395 ff).
