Reinstatement for unfiled expert opinion attachment due to technical failure in electronic submission
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) granted the plaintiff reinstatement to the former state (*Wiedereinsetzung in den vorigen Stand*), effectively curing the default caused by the failure to file the supporting attachment within the deadline for explaining a non-admission complaint against a Landgericht decision. The dispute centered on a procedural default where the appellant, a legal representative, filed the main complaint on time but failed to submit a required expert opinion attachment electronically due to an infrastructure failure, specifically a printer outage that prevented converting the electronic document to fax transmission. The court held that under §§ 233 and 544(4) Sentence 1 ZPO, the failure was not attributable to the appellant’s fault because the specific technical limitation (inability to print and fax the attachment) made timely electronic submission impossible, despite the general permissibility of alternative submission methods under § 130d ZPO during outages.
