Limits of cost assessment objection: scope restricted to calculation errors under § 66 GKG, not cost burden
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the appellant's objection, confirming that the 132 EUR in court fees assessed in September 2022 remain in force and enforceable. The dispute concerned the procedural costs arising from the lower court's ruling of August 2022, which dismissed the appellant's legal complaint against the Regional Court of Memmingen's May 2022 order as inadmissible; the appellant challenged the fee calculation but failed to present arguments against the fee assessment itself. Relying on Sections 66(1) and 66(6) of the Court Costs Act (GKG), the single judge determined that the right of objection is strictly limited to errors in the cost assessment under the legal fee schedule, and since the appellant only contested the cost burden without attacking the correct application of the relevant fee table provision, the objection was procedurally improper and substantively unfounded.

Die Erinnerung der Beschwerdeführerin vom 5. Juni 2023 gegen den Kostenansatz des Bundesgerichtshofs vom 12. September 2022 (Kassenzeichen 780022140065) wird zurückgewiesen.
[GRUENDE]
I. Mit Beschluss vom 31.
3. Das Erinnerungsverfahren ist gerichtsgebührenfrei. Außergerichtliche Kosten werden nicht erstattet (§ 66 Abs. 8 GKG).
