The Federal Court of Justice (BGH) dismissed the plaintiff’s complaint against the non-acceptance of revision, ruling that the appeal lacked fundamental legal significance and that the lower court’s decision stands. The dispute concerned a consumer loan agreement where the borrower challenged the validity of the contract via withdrawal after the loan had been fully disbursed and repaid. The court held that under Article 14(1) of Directive 2008/48/EC and established European Court of Justice jurisprudence, a borrower loses the right of withdrawal once a loan agreement is fully performed; because the contract was already completely fulfilled at the time the withdrawal was declared, the plaintiff’s claim failed. The plaintiff was ordered to bear the costs of the complaint proceedings, with the subject matter value set at €25,000.
