Exclusion of consumer loan withdrawal right upon full performance of credit agreement
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff’s complaint for non-admission of revision, leaving the lower court’s decision in favor of the defendant intact. The dispute concerned a consumer loan agreement where the borrower attempted to exercise a statutory right of withdrawal after the contract had already been fully performed. The court held that the case lacked fundamental legal significance because existing precedent, including recent rulings by the Court of Justice of the European Union, clearly establishes that no right of withdrawal under Article 14(1) of Directive 2008/48/EC exists once a loan agreement is fully fulfilled. Consequently, the plaintiff’s challenge to the lower court’s rejection of the withdrawal was unsuccessful, and the plaintiff was ordered to bear the costs of the proceedings, with the value in dispute set at up to €45,000.
