Non-appeal against civil judgment: failure to substantiate lack of damage and procedural fundamental rights violations
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's non-appeal complaint, thereby upholding the appellate court's judgment against the claimant and confirming that the defendant prevailed. The dispute arose from a civil action where the appellate court of the seventh civil senate rejected the plaintiff's claim primarily on the basis that no damage had been sustained. The higher court found that the complaint failed to demonstrate fundamental legal significance, the need for legal development, or a requirement for uniform case law under § 543 Abs. 2 ZPO, and determined that the alleged violations of procedural fundamental rights were not sufficient to warrant admission of appeal. Consequently, the decision of the lower instance stands, with the plaintiff ordered to bear the costs of the complaint proceedings.
