Discharge of burden of proof for alleged temperature-controlled exhaust gas recirculation defeat device in product liability action
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiff's non-admission complaint, leaving the appellate court's judgment in favor of the defendant in force. The dispute concerned a product liability claim where the plaintiff challenged the existence of an unlawful emissions defeat device, specifically an illegal temperature-controlled exhaust gas recirculation system, in a vehicle. The appellate court had relied primarily on the plaintiff's failure to provide concrete evidence ("greifbare Anhaltspunkte") demonstrating the presence of the allegedly unlawful device, rejecting the claim based on insufficient factual pleading. The BGH held that the complaint did not identify any fundamental legal significance or need for legal clarification regarding the standard for proving the existence of such defeat devices, thereby upholding the lower court's procedural ruling on the sufficiency of the plaintiff's facts. Key legal norms applied include § 543 Abs. 2 Satz 1 ZPO (grounds for appeal) and § 544 Abs. 6 Satz 2 Halbsatz 2 ZPO (omission of detailed reasoning).
