Admissibility of non-admission complaint: denial of fundamental legal significance in civil revision proceedings
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Civil Procedure (BGH) rejected the plaintiff’s complaint against the non-admission of revision, thereby upholding the lower court’s decision and leaving the Munich Higher Regional Court’s judgment in force; the plaintiff bears the costs of the appellate proceedings. The dispute arose from a civil matter where the plaintiff challenged the appellate court’s refusal to allow a revision appeal, asserting that the case involved issues of fundamental legal significance. The BGH found that the matter lacked such significance and that the development of law or the assurance of uniform jurisprudence did not require a decision by the highest court, further noting that the prospects for success in a revision appeal were denied. The decision was based on § 543 Abs. 2 Satz 1 and § 544 Abs. 6 Satz 2 Halbs. 2 of the Code of Civil Procedure (ZPO).
