Principality of importation in drug trafficking: control via continuous information from co-offender
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the defendant's revision as unfounded, upholding the Landgericht Zwickau’s conviction for the importation of narcotics and ordering the defendant to bear the costs of the appeal. The dispute centered on the defendant's liability for importing drugs without personally executing the physical entry, with the lower court relying on the defendant's interest in the transactions, the frequency of the offenses, and handover at his non-border-near residence to establish principalship. While the appellate panel noted that the lower court’s legal assessment regarding these specific criteria for establishing direct perpetrator status was not consistently aligned with prevailing case law, it affirmed the conviction based on the legally correct factual finding that the co-accused provided the defendant with continuous updates on the status of each procurement trip, thereby demonstrating that the defendant exercised sufficient control over the specific importation acts to satisfy the requirements for criminal liability.
