The German Federal Court of Justice (BGH) dismissed the plaintiff's non-acceptance complaint, upholding the lower court's refusal to admit an appeal to the Supreme Court, and ordered the plaintiff to bear the costs of the proceedings. The dispute concerned the validity of a withdrawal from a general consumer loan agreement, with the plaintiff arguing that his right to be heard under the German Basic Law was violated when the appellate court deemed his declaratory claim inadmissible. Although the BGH confirmed the procedural violation of the right to be heard, it held that the error did not affect the outcome because the plaintiff had failed to effectively withdraw his declaration of intent to conclude the loan contract. The decision relies on § 543 Abs. 2 ZPO and § 544 Abs. 6 ZPO, and determines that no preliminary ruling to the Court of Justice of the European Union was necessary, as the relevant legal questions regarding loan withdrawal were already clarified by prior CJEU judgments and established BGH case law.

- Volkswagen Bank u.a.), vom 21. Dezember 2023 (C-38/21, C-47/21 und C-232/21, juris Rn. 241 ff. - BMW Bank u.a.) und vom 30.
