Driver's license exclusion: mandatory individualized unfitness assessment for intentional driving without a permit
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Criminal Justice dismissed the defendant's appeal as unfounded, upholding the Berlin Regional Court's conviction and ruling that the defendant bears the costs of the appeal. The case concerned a challenge to the judgment regarding the imposition of a stand-alone exclusion period for the issuance of a driver's license pursuant to §§ 69, 69a StGB, following a conviction for intentional driving without a license. In its supplementary remarks, the court affirmed that the lower court’s reasoning for the driver's license ban satisfied legal requirements, specifically ruling that an individualized overall assessment of the circumstances of the offense and the perpetrator's personality is mandatory for offenses not explicitly listed in the catalog of § 69 Abs. 2 StGB, including intentional driving without a license. The court found that the judgment sufficiently documented specific circumstances demonstrating the defendant's unfitness to drive motor vehicles, thereby validating the application of § 69 Abs. 1 and § 69a Abs. 1 Satz 3 StGB.
