Exclusion of mortgage-secured real estate loans from EU Consumer Credit Directive in revision admission proceedings
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) dismissed the plaintiff's complaint against the non-admission of revision, upholding the appellate court's refusal to hear the case and ordering the plaintiff to bear the costs of the proceedings. The dispute concerned a real estate loan agreement secured by a mortgage, where the plaintiff challenged the lower court's decision to deny access to the supreme court instance. The BGH ruled that the case lacked fundamental legal significance and did not require further development of the law or the securing of uniform jurisprudence under § 543 Abs. 2 Satz 1 ZPO. The court further held that a preliminary ruling by the Court of Justice of the European Union was unnecessary because Directive 2008/48/EC on consumer credit agreements does not apply to real estate loans secured by mortgages under Art. 2 Abs. 2 Buchst. a and c of the Directive, thereby rendering the legal arguments moot for the purposes of non-admission.

2 ZPO abgesehen.
Der Kläger trägt die Kosten des Beschwerdeverfahrens (§ 97 Abs. 1 ZPO).
Der Gegenstandswert des Beschwerdeverfahrens beträgt bis 95.000 €.
